1. Acceptance of Terms
By accessing or using StreamTec Services LLC's platform, website, or any associated services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Services.
These Terms apply to all clients, users, and visitors of StreamTec Services. By using the Services, you represent that you are at least 18 years old and have the authority to enter into these Terms on behalf of yourself or your organization. By completing payment through our checkout, you acknowledge that you have read, understood, and agree to be bound by these Terms.
2. Description of Services
StreamTec Services provides AI-powered automation tools for local service businesses, including but not limited to:
- The Beck AI chatbot for website lead capture and customer engagement
- Missed call text-back automation via SMS
- Google review follow-up automation
- AI receptionist (voice) services
- Online scheduling integration
- Client portal for managing leads, conversations, knowledge, and settings
- CRM webhook integration
- Prospect search and outreach tools
- Website design and development services
The specific services available to you depend on your subscription plan. StreamTec reserves the right to modify, update, or discontinue any feature with reasonable notice.
3. Account Registration and Access
To access the client portal and platform features, you must register with a valid email address and password. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
You agree to notify StreamTec immediately at info@streamtecservices.com of any unauthorized use of your account.
4. Payment and Billing
StreamTec offers the following subscription plans. All prices are in USD.
- Starter: $129/month or $99/month billed annually — includes Beck AI chatbot, lead capture, scheduling, knowledge base, and portal access. One-time setup fee: $99.
- Growth: $249/month or $199/month billed annually — includes all Starter features plus missed call text-back, Google review automation, Ask Beck, and Grow with Beck prospect tools. One-time setup fee: $199.
- Professional: $449/month or $359/month billed annually — includes all Growth features plus AI Receptionist (voice). One-time setup fee: $299.
- Enterprise: Custom pricing — contact us for details.
Additional billing terms:
- Setup fees are non-refundable and due at the start of service. Setup fees are waived for clients committing to a 3-month or annual plan.
- Annual plans are billed upfront for the full year at the discounted monthly rate.
- Monthly subscription fees are billed in advance on a recurring basis.
- Overage charges apply at $1.00 per resolved conversation exceeding your plan's monthly limit. Overages are billed monthly.
- Failure to pay may result in suspension or termination of services.
Payment is processed securely through Stripe. StreamTec does not store credit card information directly. Stripe's terms of service also apply to payment processing.
5. Cancellation and Termination
Either party may terminate the service agreement with 30 days' written notice. You may cancel your subscription by contacting us at info@streamtecservices.com.
Upon termination:
- Your access to the client portal and platform will be deactivated
- The Beck chatbot widget on your website will stop functioning
- Your data will be retained for 90 days before permanent deletion, unless you request earlier deletion
- Setup fees and prior subscription fees are non-refundable
- Annual plans cancelled before the end of the billing period are not eligible for prorated refunds
StreamTec reserves the right to terminate or suspend your account immediately for material breach of these Terms, non-payment, or misuse of the platform.
6. Acceptable Use
You agree not to use the Services to:
- Violate any applicable laws or regulations
- Transmit spam, unsolicited messages, or deceptive content
- Attempt to gain unauthorized access to the platform or other accounts
- Interfere with or disrupt the platform's infrastructure
- Use the chatbot or automations for purposes unrelated to your stated business
- Collect or harvest user data in violation of applicable privacy laws
- Impersonate another person or business in chatbot responses or communications
StreamTec reserves the right to investigate and take appropriate action against anyone who violates these policies.
7. Intellectual Property
StreamTec retains all ownership rights to the platform, software, underlying technology, and the Beck AI system. These Terms do not grant you any rights to StreamTec's intellectual property beyond a limited, non-exclusive license to use the Services for their intended purpose during your subscription.
You retain ownership of all business data, content, and customer information you provide. By providing content to train the Beck chatbot (FAQs, knowledge base articles, business information), you grant StreamTec a limited license to use that content solely to deliver the Services to you.
8. Privacy and Data Security
StreamTec takes the security of your data seriously. The following practices govern how your data is handled:
- Client business data (leads, conversations, FAQs, knowledge base content) is stored in encrypted cloud infrastructure (Supabase/PostgreSQL) with row-level security controls
- All data transmitted between your browser/widget and our servers is encrypted via TLS/HTTPS
- StreamTec staff may access client data only to provide technical support, resolve issues, or investigate suspected policy violations
- Customer end-user data (names, emails, phone numbers collected via chatbot, SMS, or voice) is owned by you (the client). StreamTec acts as a data processor on your behalf
- In the event of a data breach that affects your client data, StreamTec will notify you within 72 hours of discovery
- You are responsible for obtaining appropriate consent from your end-users for the collection and processing of their personal data via chatbot, SMS, voice, and other StreamTec services
- StreamTec does not sell client or end-user data to third parties
9. AI Service Limitations
Beck AI and all AI-powered features on the StreamTec platform are subject to the following limitations and disclaimers:
- Beck AI responses are generated by large language models (via OpenAI) and may occasionally be inaccurate, incomplete, outdated, or otherwise imperfect
- Beck AI is not a substitute for licensed professional advice — including but not limited to medical, legal, financial, or safety guidance
- You are responsible for training Beck with accurate, up-to-date knowledge base content and for periodically reviewing chatbot responses for accuracy
- StreamTec is not liable for any decisions made by your end-users based on Beck's responses, or for any harm arising from AI-generated content
- AI features are powered in part by OpenAI's services; their usage policies also apply
- StreamTec makes no guarantee that AI responses will meet any specific quality, accuracy, or completeness standard
10. SMS and Telecommunications Compliance
StreamTec provides SMS automation tools including missed call text-back. The following terms apply to all SMS and telecommunications features:
- You are solely responsible for compliance with the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and all applicable federal, state, and local telecommunications laws
- By enabling missed call text-back, Google review SMS follow-ups, or any SMS feature, you represent and warrant that you have a lawful basis to contact the recipients and that recipients have provided appropriate consent
- You must maintain and honor opt-out requests from recipients. StreamTec's platform supports opt-out handling, but you bear ultimate responsibility for compliance
- You must not use StreamTec SMS services to send unsolicited marketing messages, spam, or any content prohibited by applicable law
- StreamTec provides the technical infrastructure for SMS delivery via Twilio. Twilio's acceptable use policy also applies.
- StreamTec is not liable for regulatory fines, penalties, or legal claims arising from your use of SMS features in violation of applicable law
11. Voice Services and Call Recording
The AI Receptionist feature uses voice AI technology to handle inbound phone calls on behalf of your business. The following terms apply:
- The AI Receptionist may record and transcribe calls as part of the service. Transcripts are stored in your client portal
- You are responsible for compliance with applicable call recording and wiretapping laws in your jurisdiction. Many states require all-party consent for call recording
- StreamTec recommends — and where legally required, you must — include a verbal disclosure at the start of AI-handled calls (e.g., "This call may be recorded and handled by an AI assistant")
- AI-generated voice responses may not always be accurate. You should monitor call transcripts and configure the AI Receptionist appropriately for your business
- StreamTec is not liable for regulatory violations, legal claims, or business losses arising from your use of the AI Receptionist feature without proper disclosures
12. Third-Party Service Providers
StreamTec uses the following third-party services to deliver the platform. By using StreamTec, you acknowledge that these providers' terms also apply where relevant:
- Stripe — Payment processing (stripe.com/legal)
- Twilio — SMS and voice services (twilio.com/legal/tos)
- OpenAI — AI language models and voice AI (openai.com/policies)
- Supabase — Cloud database infrastructure
- Google — Review integrations and Places API (policies.google.com)
- Calendly — Scheduling integration (calendly.com/terms)
- Resend — Transactional email delivery
StreamTec is not responsible for outages, policy changes, or service disruptions caused by these third-party providers. Downtime or feature changes by third-party services do not entitle you to refunds or credits.
13. Limitation of Liability
StreamTec Services is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, StreamTec expressly disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
StreamTec shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services, including but not limited to:
- Lost profits, lost revenue, lost leads, or lost customers
- Inaccurate, incomplete, or inappropriate AI-generated responses by Beck or the AI Receptionist
- Missed leads, missed calls, or failed SMS/email delivery
- Downtime, outages, or interruptions in service (including those caused by third-party providers)
- Unauthorized access to your account or data
- Actions taken by your end-users based on chatbot or AI responses
StreamTec's total aggregate liability to you for any claim arising from these Terms or your use of the Services shall not exceed the total fees paid by you to StreamTec in the three (3) months immediately preceding the event giving rise to the claim.
14. Indemnification
You agree to indemnify, defend, and hold harmless StreamTec Services LLC, its owners, officers, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:
- Your use of the Services or violation of these Terms
- Your violation of any applicable law, including telecommunications and privacy laws
- Your violation of any third-party rights, including those of your end-users
- The content you provide to train or configure the platform (FAQs, knowledge base, business information)
- Claims by your end-users arising from chatbot interactions, SMS messages, voice calls, or any automated communications sent through the platform
15. Governing Law
These Terms are governed by the laws of the State of Wisconsin, USA, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Wisconsin. You consent to the personal jurisdiction of such courts.
16. Changes to These Terms
StreamTec may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. We will notify active clients of material changes by email at least 14 days before they take effect. Continued use of the Services after changes take effect constitutes your acceptance of the updated Terms.
